How to Get Rid of a Homeowners Association

Homeowners associations (HOAs) are meant to manage common areas and property maintenance in housing developments and planned unit developments (PUDs) through member fees. HOAs develop rules for members to follow to encourage property upkeep and to increase property value. Ideally, these rules provide members with a sense of comfort and satisfaction, but if the rules are too restrictive it's easy to feel that your individual ownership rights are obstructed. In these situations, seeking to dissolve your HOA is a common course of action.

Review the governing documents of your HOA, known as the covenants, conditions and restrictions (CC&Rs), for official guidelines on HOA dissolution.

Research state laws concerning the legislative and regulatory rules that affect the location of your property. Several states adhere to the Uniform Common Interest Ownership Act (UCIOA) or the Uniform Planned Community Act (UPCA).

Locate a real estate attorney who has a record of success in HOA disputes and dissolution, and present him with your findings.

Discuss your findings with other homeowners within your HOA to get their feedback and position on the subject.

Ask to convene a meeting of your association's elected officials and board members to vote on dissolution.

Vote when all required persons are present. When seeking dissolution, a super majority or a majority is often required for successful passage.
